Article 1 Purpose

The general conditions of sale described below detail the rights and obligations of the company BIOABONDANCE, in particular via EASYPERMA and of its customers within the framework of the sale of coaching services, training and online courses.
Any service provided by the BIOABONDANCE company, in particular via EASYPERMA, implies the buyer's unreserved acceptance of these general conditions of sale.

Article 2 Presentation of products

The characteristics of the products offered for sale are presented in the "Products" section of our site. The photographs do not enter into the contractual field. BIOABONDANCE cannot be held responsible, in particular via EASYPERMA, if errors have been made. All texts and images presented on the BIOABONDANCE website, in particular via EASYPERMA, are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden. 

Article 3 Period of validity of sales offers

Distance learning courses are valid for 12 months from the date of registration. If, at the end of this period, the person has not started the course, their access will be automatically terminated. Coaching services are valid for a period of three months, or any other period indicated on the site.

Article 4 Product prices

The prices indicated on our site are in euros and include all taxes. The amount of VAT is specified when the customer selects a product. For sales abroad, the price is maintained in Euros and the price in another currency is given as an indication.

BIOABONDANCE, notably via EASYPERMA, reserves the right to modify its prices at any time but the products ordered are invoiced at the price in force when the order is registered.

 No discount will be granted for early payment.

Article 5 Ordering

Customers confirm their order by clicking on the "Confirm your order" link at the bottom of the "Order summary" page, after having accepted these terms and conditions of sale. Before confirming their order, customers are systematically given the opportunity to check each of the elements of their order, so that they can correct any errors.

BIOABONDANCE, notably via EASYPERMA, confirms the order by e-mail; this information notably includes all the elements of the order and the customer's right of withdrawal.

The data recorded by BIOABONDANCE, notably via EASYPERMA, constitutes proof of the nature, content and date of the order. The latter is archived by BIOABONDANCE, in particular via EASYPERMA under the conditions and within the legal deadlines; the customer can access this archiving by contacting the Customer Relations department. 

Article 6 Terms of payment

Payment for orders is made immediately upon online registration by credit card or any other means offered on the site.

Article 7 Withdrawal period

The right of withdrawal does not apply to the purchase of courses, coaching sessions or online training (you waive your right of withdrawal for digital content provided on an intangible medium whose execution has begun with your agreement).

Article 8 Late payment (clause applicable to professionals)

In the event of total or partial non-payment of the services provided on the due dates pre-established with the user, the purchaser must pay the BIOABONDANCE company, in particular via EASYPERMA, a late payment penalty equal to one and a half times the legal interest rate and the cessation of access to the online course platform.

The legal interest rate is that in force on the day of delivery of the goods.

This penalty is calculated on the amount outstanding, excluding tax, and runs from the due date of the price without any prior formal notice being required.

In accordance with articles 441-6 c. com. and D. 441-5 c. com. any delay in payment shall automatically entail, in addition to the late payment penalties, an obligation for the debtor to pay a fixed indemnity of €40 for collection costs.

An additional indemnity may be claimed, with supporting evidence, when the recovery costs incurred exceed the amount of the fixed indemnity. 

Article 9 Customer relations - After-sales service

For any information, questions or complaints, the customer may contact the company's Customer Relations department from Monday to Friday, 9am to 6pm.

Article 10 Personal data

In accordance with the French Data Protection Act, learners have the right to access and rectify information stored in our databases.

Article 11 Applicable law and dispute resolution

BIOABONDANCE is established in France in a stable and durable manner in order to carry out its activity.

Therefore, these General Terms and Conditions of Sale are subject to the application of French law, to the exclusion of the provisions of the Vienna Convention. Any signature by means of the communication of the bank card number and ratification of the General Terms and Conditions of Sale constitutes proof of commitment by the customer. 

In the event of a dispute or claim, the customer shall first contact the seller to obtain an amicable solution.

In the absence of an amicable agreement, the customer may bring proceedings before the competent court in the place of BIOABONDANCE's registered office.
